E-TECH USER AGREEMENT

Parties to the Agreement
This User Agreement (hereinafter referred to as the “Agreement”) is concluded between E-TECH ENERGY TECHNOLOGIES AND INNOVATION INDUSTRY INC. (hereinafter referred to as “E-TECH”) (MERSIS No: 0323117278400001) and the user who downloads the application to benefit from the services to regulate the terms relating to the rental services with the sharing model of the Charging Stations and the vehicles charged by the Charging Stations (hereinafter referred to as the “Service”). E-TECH and the User shall be referred to individually as “Party” and collectively as “Parties”. -
Subject and Scope of the Agreement
This Agreement must be carefully read by any individual (the “User”) who downloads the E-TECH mobile application before starting to use the mobile application. If the terms set forth in this Agreement are not accepted by the User, access to the Services and use of the Services is not permitted. In the event that the User accesses and/or starts using the Services via the application, it is assumed that all terms and conditions of this Agreement that establish a contractual relationship between the User and E-TECH have been accepted and approved. -
Definitions
The following definitions shall apply in this Agreement:
3.1 E-Tech Charging Station: Refers to the Charging Station vehicles that have been previously offered and made available for use, provided that the conditions specified in this Agreement are complied with.
3.2 Fee: Refers to the fee determined according to the User’s reservation and/or usage duration in exchange for KW hour usage, excluding other fees (damage fees, penalties, etc.) to be paid by the User.
3.3 Services: Refers to the Charging Station Services provided by E-TECH.
3.4 Rules: Includes all rules regarding the User's use of the Services contained in this Agreement or published in other sections of the E-TECH mobile application.
3.5 User: Refers to the end-user who wishes to benefit from the Services provided by E-TECH by using the E-TECH mobile application. -
Rights and Obligations of the Parties
4.1 The User declares, accepts, and undertakes that all information provided during membership is always correct, complete, genuine, and up to date, and that they are of legal age. The scope of this information is determined by E-TECH and may be changed, expanded, or restricted as necessary; in case of any risk arising and/or doubt about the accuracy of the declared information, E-TECH may suspend the membership, block it, or temporarily suspend it. This Agreement supersedes and replaces any previous agreements and contracts made between the Parties.
4.2 E-TECH may, at its sole discretion, make additional updates that may be published in the application from time to time, which shall be considered part of this Agreement. E-TECH will publish the updated terms in the same area in case of any changes and will notify Users through the application. The renewed updated Agreement shall be effective and in force from the moment it is published in E-TECH's database, and all existing or new Users will be subject to the terms and conditions of the updated Agreement. Continuing to access or use the Services after such an in-app notification shall mean that you accept the amended provisions.
4.3 E-TECH has the right to terminate this Agreement and the Services immediately for any reason at any time, and E-TECH has no obligation to ensure the continuity of its services.
4.4 The E-TECH application is a technology platform that allows Users to rent micromobility transportation vehicles through a shared model, and E-TECH provides these services by enabling real-person Users to see specific micromobility vehicles near them and rent them within certain rules through the mobile application. The total fee calculated at the end of the service acquisition is collected through licensed institutions by the Banking Regulation and Supervision Agency and is not subject to this Agreement. E-TECH may perform the collection/blocking process for the amounts determined before the Charging Service starts for reasons related to security, verification, and others, which are communicated to the User visibly on the application screen.
4.5 The User is required to register for an active user service account (“Account”) to benefit from the Services. Having an Account and benefiting from the Services requires that the User is at least 18 years of age for the E-TECH Charging Station. E-TECH is not responsible for individuals who benefit from the Services in violation of this age or driving license requirement. E-TECH is authorized to take action against the parents and official authorities of these underage individuals. If reasonable doubt arises for the safety of the User and the public, E-TECH may request identity verification for the User to access and use the Services.
